Training with Hart – Behavioural Services

1. Acceptance of Terms

By submitting a booking form, paying a deposit, or engaging services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

A binding agreement is formed when a booking is confirmed and/or services are provided.

If you are booking on behalf of another person, you warrant that you have authority to do so and accept responsibility under these Terms.

2. Services

Training with Hart provides behavioural consultation, assessment, and guidance services.

Recommendations are based on information provided at the time of consultation. Behavioural outcomes vary and no guarantee of specific results is made.

Clients acknowledge that behaviour modification requires ongoing implementation and management outside of consultation sessions.

3. Fees, Deposits and Payment

3.1 Deposits

A deposit is required to secure all bookings. Bookings are not confirmed until the deposit is received.

 

3.2 Payment Timing

Full payment is due at the time services are provided unless otherwise agreed in writing prior to the consultation.

3.3 Release of Reports

Written reports, behavioural plans, or documentation will not be released until payment has been received in full.

3.4 Third-Party Payment

If a third party (including but not limited to a support provider, organisation, insurer, or company) is intended to pay for services, payment in full is required 24 hours prior to the booking.

 

The Client remains legally responsible for payment unless a written agreement transferring liability is provided prior to the consultation.Any reimbursement arrangements between the Client and a third party are separate from this agreement.

3.5 Overdue Accounts

If payment is not received by the due date:

  • Services may be suspended;

  • Future bookings may be cancelled;

  • The matter may be referred for debt recovery; and/or

  • Civil recovery action may be commenced without further notice.

The Client agrees to indemnify Training with Hart for reasonable costs incurred in recovering unpaid debts, including administrative, collection, and tribunal filing costs.

4. Cancellations and Rescheduling

Cancellations or rescheduling requests must be made at least 48 hours prior to the scheduled appointment.

  • Cancellations within 48 hours may result in forfeiture of the deposit.

  • Failure to attend a scheduled appointment (no-show) may result in the full consultation fee being charged.

  • Rescheduling is subject to availability.

Refunds are not provided once services have been delivered.

5. Safety and Client Responsibilities

The Client must disclose prior to consultation:

  • Any history of aggression or bite incidents;

  • Known medical or behavioural conditions;

  • Environmental risks that may impact safety.

The Client remains responsible for the safety and control of their animal at all times.

Training with Hart reserves the right to terminate or refuse a session if safety is compromised.

 

6. Limitation of Liability

To the extent permitted by law:

  • Training with Hart is not liable for indirect, incidental, or consequential loss.

  • Liability for services is limited to the amount paid for the consultation in question.

  • No warranty is given regarding behavioural outcomes.

Nothing in these Terms excludes rights under the Australian Consumer Law.

 

7. Recording, Transcription and Use of Technology

Consultations conducted in person, via Zoom or other digital platforms may be recorded for the purpose of:

  • Creating accurate written reports;

  • Generating transcripts;

  • Clinical documentation and record-keeping.

 

Transcripts and draft reports may be generated using secure AI-assisted software tools.

Recordings and transcripts:

  • Are used solely for documentation and service delivery;

  • Are stored securely;

  • Are not shared externally without consent unless required by law.

By engaging services, the Client consents to this process.

If a Client does not consent to recording, they must notify Training with Hart prior to the consultation.

 

8. Privacy

Client information is handled in accordance with applicable Australian privacy laws.

Personal information is used only for:

  • Provision of services;

  • Communication;

  • Documentation;

  • Administrative and invoicing purposes.

Information will not be disclosed to third parties without consent unless required by law.

 

9. Intellectual Property

All written reports, training plans, materials, and documentation remain the intellectual property of Training with Hart.

Reports are provided for personal use only and must not be reproduced, distributed, or used commercially without written consent.

 

10. Governing Law

These Terms and Conditions are governed by the laws of Queensland, Australia.

Any disputes will be resolved through appropriate civil processes within Queensland, including the Queensland Civil and Administrative Tribunal (QCAT) where applicable.

 

11. Group Classes

 

11.1 Eligibility and Suitability

Age and Vaccination Requirements

  • Preschool/Socialisation Class: 8–16 weeks of age with proof of first vaccination.

  • Adolescent–Adult Relax+: 16 weeks and over with proof of full vaccination.

  • Adolescent–Adult Intermediate: 16 weeks and over with proof of full vaccination.

Proof of vaccination may be requested prior to or at commencement of the course.

 

Class Entry Requirements

  • Only one puppy/dog per household may attend a course (no littermates).

  • Dogs enrolled in adolescent–adult classes must be confident and safe to be in a room with up to three other dogs and people without displaying adverse reactions.

  • Dogs must be able to take food in the class environment.

  • Dogs entering Intermediate or Advanced classes must have either:

    • Successfully completed Preschool/Beginner with Training with Hart; or

    • Undertaken a suitability assessment and been approved by the Trainer.

If a dog is deemed unsuitable for the class environment due to behavioural concerns, the Trainer reserves the right to remove the dog from the course for safety reasons.

Where removal occurs:

  • No refund will be provided if suitability requirements were not met or were misrepresented at booking.

  • A credit may be offered toward one-on-one training at the Trainer’s discretion.

 

11.2 Equipment Requirements

The following equipment is not permitted in group classes:

  • Choke chains

  • Prong collars

  • Shock/electronic collars

  • Head collars

  • Stop-pull harnesses

  • Retractable leads

Training with Hart utilises force-free, reward-based training methods.

 

11.3 Children at Classes

  • Children may attend Preschool classes only.

  • No children are permitted to attend Relax+ classes.

  • Children remain the responsibility of their parent or carer at all times.

  • Children must behave respectfully toward other attendees and animals.

The Trainer reserves the right to request that a family leave the class if a child’s behaviour is disruptive or compromises safety.

If a class is missed or discontinued due to disruptive behaviour, no refund will be provided.

11.4 Catch-Up Sessions

Catch-up classes may be offered at the Trainer’s discretion but are not guaranteed.

12. Contact Information

The Client is responsible for providing accurate contact details at the time of booking.

Training with Hart is not responsible for missed communications resulting from incorrect information submitted in booking forms. Automated communications are generated using the information supplied by the Client.

13. Refund and Cancellation Policy (Courses and 1:1 Services)

13.1 Payment Requirements

  • Full payment is required to secure a place in a group class or course.

  • A deposit is required to book a 1:1 initial consultation.

  • A deposit is required to book follow-up sessions.

Bookings are not confirmed until payment or deposit is received.

 

13.2 Refund Schedule

Full Refund

A full refund will be provided if cancellation occurs:

  • More than 7 days before the course start date; or

  • In the event of the animal’s death or severe injury/illness (evidence may be requested).

 

50% Refund

A 50% refund will be provided where cancellation occurs:

  • Between 7 days and 48 hours prior to the start date or consultation.

 

No Refund

No refund will be provided:

  • For cancellations within 48 hours of a group class start date;

  • For cancellations within 48 hours of a 1:1 consultation;

  • For failure to attend (no show);

  • For missed classes;

  • Where the dog is booked into an unsuitable class due to the owner not reviewing the eligibility requirements;

  • Where the dog is unsuitable for the class environment and suitability requirements were misjudged by the owner.

14.  Prepaid Services and Account Credits

Clients may hold prepaid sessions, service credits, or unused balances from previously purchased services. These must be used within 12 months of the original purchase date or credit issue date, unless otherwise agreed in writing.

 

Any unused services or credits remaining after this period will expire and cannot be redeemed, refunded, or transferred.

​

Where prices have changed since the original purchase, any remaining credit may be applied toward the current price of services, with any difference payable at the time of booking.

15. Behavioural Risk & Bite Liability 

  • Clients acknowledge that animals may behave unpredictably and that training and behaviour consultations involve inherent risk, including the potential for bites, scratches, or other injuries.

  • While Training With Hart provides guidance aimed at improving safety, welfare, and behaviour outcomes, no guarantee can be made that an animal will not display aggressive or dangerous behaviour.

  • Clients remain fully responsible for the management, handling, and control of their animal at all times, including following safety and management recommendations provided during consultations.

  • Training With Hart accepts no liability for injury, damage, or loss resulting from the behaviour of a client’s animal.

 

16. Veterinary & Medical Considerations

  • Behavioural concerns may have underlying medical contributors. Training With Hart may recommend that a client consult with their veterinarian or veterinary behaviourist where appropriate.

  • Training With Hart does not diagnose medical conditions or prescribe medication.

  • Where veterinary assessment is recommended, clients acknowledge that behavioural progress may depend on appropriate veterinary investigation or treatment, and recommendations may be limited until medical factors are addressed.

 

17. Training Outcomes

  • Behaviour modification and training outcomes depend on many factors including the animal’s history, genetics, environment, health, and the consistency with which recommendations are implemented.

  • Training With Hart provides evidence-based guidance and support; however specific behavioural outcomes cannot be guaranteed.

  • Clients acknowledge that successful behaviour change requires ongoing client participation and implementation of recommended management and training strategies.
